These Terms explain the rules for using FarmSync Aqua's website, onboarding forms, farm management tools, feed store, financing workflows, reports, and support services. By creating an account, submitting information, placing an order, or using the platform, you agree to these Terms.
1. The service
FarmSync Aqua helps fish farmers and authorised groups manage onboarding, farms, cages, stock batches, feeding logs, measurements, mortality, feed recommendations, feed orders, financing records, repayments, harvests, sales, and reports.
The platform supports farm decisions but does not replace professional aquaculture, veterinary, financial, legal, tax, or insurance advice.
2. Accounts and access
- You must provide accurate, complete, and current information.
- You are responsible for keeping login details confidential and for activity under your account.
- Access may depend on role, approval status, group membership, verification, and compliance with these Terms.
- We may suspend or restrict access if information appears false, unlawful, unsafe, fraudulent, or harmful to the platform or other users.
3. Farmer and farm records
Feed recommendations, reports, dashboards, financing reviews, and harvest summaries depend on the information entered into the platform. You are responsible for checking records before relying on them, including stock counts, measurements, mortality, feed use, costs, prices, and payments.
We may correct obvious system errors, request supporting information, or reject records that appear inaccurate, duplicate, misleading, abusive, or outside the purpose of the platform.
4. Feed orders, prices, and delivery
- Prices, stock availability, delivery timing, and product details may change before an order is confirmed.
- An order is accepted only when we confirm it or begin fulfilment.
- You must provide accurate contact and delivery information.
- Risk in delivered goods may pass when the order is collected, delivered, or received by your authorised representative.
- Returns, replacements, or refunds are handled case by case where goods are defective, incorrectly supplied, or otherwise required by law.
5. Financing, disbursements, and repayments
Financing features may help record applications, approvals, disbursements, repayments, balances, and related operational data. Submitting an application does not guarantee approval, disbursement, product availability, or any particular credit terms.
Any approved financing may be subject to separate written terms from FarmSync Aqua or a financing partner. You are responsible for reviewing and honouring those terms, including repayment amounts, dates, fees, and consequences of default.
6. Acceptable use
You must not:
- Use the platform for fraud, unlawful activity, harassment, impersonation, or misleading records.
- Access, copy, alter, or delete data you are not authorised to use.
- Interfere with security, availability, or performance of the platform.
- Upload malicious code or attempt to bypass authentication, permissions, or rate limits.
- Use reports or data in a way that violates another person's rights or privacy.
7. Privacy and data protection
Our Privacy Policy explains how we handle personal data under Kenyan data protection requirements. By using the service, you agree that we may process data as described there and as needed to provide the service.
8. Intellectual property
FarmSync Aqua, the platform design, software, reports, text, branding, and related materials belong to us or our licensors. You may use them only as needed to access the service. You keep ownership of the farm and business information you submit, but you allow us to use it to operate, secure, improve, and support the service.
9. Availability and changes
We aim to keep the service reliable, but we do not promise uninterrupted or error-free access. We may change, suspend, improve, or discontinue parts of the platform, including features, reports, pricing, suppliers, or workflows.
10. Liability
To the extent allowed by law, FarmSync Aqua is not liable for indirect loss, lost profit, lost harvest value, production loss, missed financing, data entered incorrectly by users, third-party delays, or events outside our reasonable control. Nothing in these Terms limits liability that cannot legally be limited.
11. Termination
You may stop using the service at any time. We may suspend or close an account where required by law, where the user breaches these Terms, where continued access creates risk, or where the account is no longer authorised. Some records may be retained where needed for legal, accounting, financing, audit, dispute, or security reasons.
12. Governing law and disputes
These Terms are governed by the laws of Kenya. We encourage users to contact us first so we can try to resolve issues quickly. If a dispute cannot be resolved informally, it may be handled by the competent courts or dispute resolution bodies in Kenya.
